Humanitarian and Compassionate (H&C) Grounds
The Humanitarian and Compassionate (H&C) stream offers a discretionary pathway to permanent residence for individuals currently in Canada who do not qualify under other immigration programs but face exceptional hardship or unique circumstances. This is a deeply compassionate safety net under Section 25(1) of the Immigration and Refugee Protection Act (IRPA)—not a fallback, but a carefully considered, case-by-case exception.
This route is designed for those who cannot return home without facing serious and undeserved challenges, such as children’s separation, serious health concerns, or long-standing community ties. Applying under H&C involves more than just meeting criteria—it requires telling a compelling and well-documented story.
How It Works
Confirm you’re eligible for H&C:
You must be in Canada, ineligible for other PR routes (e.g., Express Entry, family sponsorship, Protected Person), and your situation must justify special consideration.Explain which requirement you need an exemption from:
Clearly state what IRPA requirement(s) you can’t meet, and why humanitarian and compassionate grounds should override it.Gather strong supporting evidence:
Include proof of your establishment in Canada (like employment, community involvement), family ties, medical conditions, hardship in your home country, and—especially—documentation showing why removal would harm any children involved.Submit your application online:
Apply through the PR portal, completing the generic form (IMM 0008) and any required guides (e.g., Guide 5291). Note: You can only have one H&C application under review at a time.Await a discretionary decision:
Immigration officers assess every case holistically. There’s no points system; success depends on how compelling your circumstances are overall.
Why This Path Might Be Right for You
Tailored to your situation: H&C considers the full picture of your case it’s about humanity, not checkboxes.
For those with deep ties to Canada: Individuals who’ve built lives here—through work, family, or community—may have a strong case.
Child-focused decisions: The “best interests of the child” is a legal priority under H&C, and can significantly strengthen a case.
With Nivara Immigration, you’ll work with experienced consultants to identify compelling factors, structure your personal narrative, compile strong documentation, and submit a clear, persuasive application aligned with IRCC expectations.
Important Reminders
H&C is highly discretionary—approval is never guaranteed. Every case depends on its unique circumstances.
Honesty is critical—any misrepresentation can lead to refusal and impact future applications.
Be patient—processing times vary widely, and you may be asked for additional documents during the review.
